Welcome to getIt. These Terms and Conditions ("Terms") govern your access to and use of the website, mobile applications, and services provided by GetIt Technologies Pvt. Ltd (hereinafter "GetIt", "we", "us", or "our"), having its registered address at 176031 Jwalamukhi, Kangra, Himachal Pradesh, India.

Please read these Terms carefully before using the Platform. By registering an account, placing an order, or accessing the services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately cease using the Platform.

1. Eligibility and Registration

To use our Platform, you must be at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872. During registration, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

2. Services Description

GetIt operates a hyperlocal delivery and ride logistics marketplace platform that connects customers with local merchants (vendors) and independent delivery partners (riders).

• Vendor Orders: We facilitate the display, ordering, and delivery of products (such as food, groceries, products) listed by third-party merchants on the Platform.
• Courier/Ride Bookings: We offer ride-booking and instant custom package delivery dispatch services, connecting customers with independent riders in Jwalamukhi and Dharamshala.

GetIt acts solely as an intermediary connector. We do not manufacture or prepare the products sold by vendors, nor do we directly employ riders, and we assume no liability for the actions or omissions of vendors or riders.

3. Pricing, Payments and Taxes

All prices displayed on the Platform are in Indian Rupees (INR) and are set by the respective vendors or calculated dynamically based on distance (for delivery and rides).

• Fees: We may charge delivery fees, platform fees, booking fees, or surge charges depending on the order type, distance, and traffic/weather conditions. These fees will be visible on the checkout screen before payment.
• Secure Payment processing: Payments are collected using secure, third-party payment gateways (e.g. Cashfree). You agree to pay all amounts due for your order, including applicable taxes (GST, TCS).
• Merchant Prices: While we try to ensure prices are updated, vendors reserve the right to alter pricing, and we do not guarantee exact price matching with offline rates.

4. Order Cancellations and Amendments

Orders can only be cancelled or modified within the strict timelines set out in our Refund & Cancellation Policy. Once a vendor has accepted a product order or preparation has commenced, or a rider has reached a pickup point for a ride booking, cancellation fees up to 100% of the order value may apply.

5. Delivery and Fulfilment

Delivery timelines displayed on the Platform are estimates only. While our riders make every effort to deliver products within the estimated window, delays may occur due to traffic, weather, vendor delays, or force majeure events.

You must ensure someone is present at the delivery location to receive the package. If delivery fails because of incorrect address coordinates, unavailability of the receiver, or lack of authorization to enter premises, you will still be charged the full order amount.

6. Prohibited Activities

When using our Platform, you agree not to:

• Provide false, inaccurate, or misleading information.
• Use the Platform to transport illegal, hazardous, prohibited, or restricted items under Indian law (including weapons, narcotics, explosives, or contraband).
• Engage in fraudulent transactions or abuse our refund systems.
• Interfere with or damage the security and performance of our servers, code, or networks.
• Attempt to reverse-engineer, decompile, or copy the proprietary source code of the Platform.

7. Limitation of Liability and Indemnification

To the fullest extent permitted by law, GetIt, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from your use of the Platform, including but not limited to food quality issues, rider misconduct, delivery delays, or payment processing errors.

You agree to indemnify and hold harmless GetIt Technologies Pvt. Ltd from any claims, losses, liabilities, costs, or demands arising out of your breach of these Terms or violation of any laws.

8. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms, including validity or enforceability, shall be subject to the exclusive jurisdiction of the courts located in Kangra, Himachal Pradesh, India.
